Required contents of a notice
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to be infringed.
- The URL of the allegedly infringing material on BellusTowne.
- Your name, address, phone number, and email.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
Misrepresentations under §512(f) carry liability, including damages and attorneys' fees.
Counter-notice
If you believe your content was removed in error, you may submit a counter-notice to the same address containing your signature, identification of the removed material and its prior location, a statement under penalty of perjury that the removal was the result of mistake or misidentification, your name/address/phone, and a statement consenting to the jurisdiction of the federal court for your district (or, if outside the U.S., any district in which we may be found).
Repeat infringers
Accounts found to be repeat infringers will be permanently banished from the Town.
AI-generated content
BellusTowne’s Forge familiars (Speaker, Listener, Limner, and their kin) produce text, audio, and images derived from prompts supplied by Citizens. We treat takedown notices that allege infringement by AI-generated output under the same procedure as any other notice under this Policy. Where the disputed output was produced from a Citizen prompt, the Citizen who issued the prompt is treated as the uploader for §512(g) counter-notice purposes, and repeat-infringer termination applies to that Citizen’s account.
A notice that targets AI-generated content should, where possible, identify both (a) the copyrighted work alleged to be infringed and (b) the specific BellusTowne URL where the output appears. Allegations directed solely at the training data or model weights of a third-party AI provider, rather than at output hosted on BellusTowne, fall outside the scope of this Policy and should be directed to the relevant provider.
